These Terms of Use ("Terms") govern your access to and use of the Cybörü autonomous offensive-security platform, including the web application, APIs, autonomous agents, reports, and any related services (together, the "Service"). The Service performs active security testing on your behalf — reconnaissance, analysis, attack-chaining, exploitation, and proof-of-impact — so please read these Terms carefully. This is placeholder language and should be reviewed by qualified legal counsel before publication.
1. Acceptance of terms
By creating an account, clicking "I agree," or otherwise accessing the Service, you agree to be bound by these Terms and by any policies referenced here, including our Privacy Policy and the applicable order form. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, and "you" refers to that entity. If you do not agree, you may not access or use the Service.
2. Authorized use & scope
Cybörü directs autonomous, active security testing against the targets you define. You may only point the Service at assets that you own or that you are explicitly and lawfully authorized to test. You are solely responsible for the accuracy, currency, and legality of every scope you configure.
- You confirm you hold written authorization to test each in-scope domain, IP range, application, and account.
- You will keep scopes current and promptly remove any asset you no longer own or are no longer authorized to test.
- You will not direct the Service at third-party systems, shared infrastructure, or production assets where testing is prohibited.
- You acknowledge that active testing can generate traffic, alerts, or transient effects on in-scope systems, and you accept responsibility for managing that within your environment.
3. Accounts
You must provide accurate registration information and keep it current. You are responsible for safeguarding your credentials and API keys and for all activity of every user under your account. Notify us promptly of any unauthorized access or suspected compromise. We may suspend or restrict accounts where necessary to protect the Service, our customers, or third parties.
4. Acceptable use & prohibited conduct
The Service exists for legitimate, authorized security testing. You agree not to use it in any way that is unlawful, harmful, or outside the boundaries of your authorization. Without limiting the foregoing, you may not:
- Test, scan, or attack systems you do not own or lack written authorization to assess.
- Use the Service to exfiltrate, ransom, destroy, or commercialize data obtained during testing.
- Circumvent the scope controls, rate limits, or other safety guardrails built into the platform.
- Resell, sublicense, or provide the Service to third parties except as expressly permitted in writing.
- Reverse engineer, copy, or create derivative works from the Service except as allowed by law.
- Interfere with the integrity, security, or performance of the Service or its underlying infrastructure.
5. Intellectual property
The Service — including its software, autonomous agents, models, methodologies, and documentation — is owned by Cybörü and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription term. You retain ownership of your data and your in-scope environment, and the findings, attack chains, and proof artifacts generated for your engagements are yours to use internally and for remediation. We may retain anonymized, aggregated data to operate and improve the Service.
6. Fees
Fees, billing cycles, and usage entitlements are set out in your order form or subscription plan. Unless stated otherwise, fees are non-refundable and exclusive of taxes. We may adjust pricing for renewal terms with reasonable notice. Failure to pay may result in suspension of the Service. You are responsible for any applicable taxes other than taxes based on our net income.
7. Disclaimers & limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Security testing is inherently probabilistic; we do not warrant that the Service will identify every vulnerability or that testing will be free of disruption. To the maximum extent permitted by law, Cybörü will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our aggregate liability arising out of or relating to the Service will not exceed the fees you paid in the twelve months preceding the event giving rise to the claim.
8. Indemnification
You agree to defend, indemnify, and hold harmless Cybörü and its affiliates, officers, and employees from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, the scopes you configure, your breach of these Terms, or your violation of any law or third-party right. This includes any claim arising from testing directed at assets you were not authorized to test.
9. Termination
You may stop using the Service at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or activity that poses a risk to the Service or others. Upon termination, your right to use the Service ends and we may delete your data in accordance with our retention practices. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
10. Governing law
These Terms are governed by the laws of the jurisdiction in which Cybörü is established, without regard to its conflict-of-laws principles. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except where applicable law requires otherwise.
11. Changes
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
